California is a community property state. This means that most assets and property that are purchased and acquired throughout the course of the marriage is subject to division upon dissolution of the marriage, including wages, retirement accounts, and pension. However, there are several exceptions to the community property law. For example, an inheritance in one spouse’s name is not considered community property, but separate property. Assets and property held before the marriage are considered separate property and are usually not subject to division.

There is no common law marriage in California. The actual marriage begins on the date listed on the marriage license. From this date forward, all assets gained are subject to division.
